What data we process and why
Profile review request
This is the “Request a review of your profile” form. You fill it in if you are a creator and would like us to assess your profile. These are the details we ask you for:
| Information | Required? |
|---|---|
| What you are looking for: starting from scratch, already earning or interested in the webcam studio | Yes |
| Name | Yes |
| Yes | |
| Country | Yes |
| Yes | |
| Instagram username | Yes |
| TikTok username | No |
| OnlyFans link or username, if you already have an account | No |
| Message | No |
| Confirmation that you are 18 or older | Yes |
| Confirmation that you have read this policy | Yes |
What we use it for. To assess your profile and contact you on WhatsApp or by email, to explain how we could work with you and to offer you our services. To carry out that assessment, we review your public social media profiles based on the usernames you give us. If you do not use social media, you can send us photos of yourself on WhatsApp.
What we will never ask you for. Passwords or explicit photos. We also do not need health data or any other particularly sensitive data, so please do not include it in your message.
Legal basis. Taking the pre-contractual steps you ask us to take when you send your request (Article 6(1)(b) of the GDPR) and your consent (Article 6(1)(a) of the GDPR), which you can withdraw at any time.
If you do not give us the required information, we cannot assess your request. The optional fields help us get to know you better, but you can leave them blank.
Spam protection. The form has a hidden field that people cannot see and that only bots fill in: if it arrives filled in, we discard the submission. We also use Cloudflare Turnstile to check that whoever submits the form is a person. To do this, Turnstile analyzes technical data from your browser and your connection, such as your IP address. We do this on the basis of our legitimate interest in protecting the website and its forms against spam and abuse (Article 6(1)(f) of the GDPR).
Job applications
If you would like to join the team, you can send us your application through the jobs page. We ask for your name, email, WhatsApp, country, the role you are interested in, the languages you speak and your experience. If you wish, you can add a link to your LinkedIn profile or portfolio and attach your CV.
What we use it for. To manage our hiring processes: assessing your application and contacting you if it fits what we are looking for.
Legal basis. Taking the pre-contractual steps you ask us to take when you send us your application (Article 6(1)(b) of the GDPR).
If you do not give us the required information, we cannot assess your application. In your CV, include only what is relevant to the role: we do not need data about your health, ideology or religion, or any other particularly sensitive data.
Messages on WhatsApp or by email
If you write to us on WhatsApp or by email, we process your phone number or email address, your name (and your WhatsApp profile photo, if it is visible) and whatever you tell us or send us in the conversation.
What we use it for. To reply to you and, if you ask us to, to assess your profile or tell you about our services.
Legal basis. Your consent, which you give us by writing to us (Article 6(1)(a) of the GDPR), and, when you ask us for information about working with us, taking pre-contractual steps (Article 6(1)(b) of the GDPR).
When you browse the website
To show you the website, Cloudflare, the provider that hosts it, receives technical data about your connection, such as your IP address, your browser and the pages you visit. This data is used to make the website work and to protect it against attacks and abuse, on the basis of our legitimate interest in keeping it available and secure (Article 6(1)(f) of the GDPR).
If at some point we enabled Cloudflare Web Analytics to find out how many visits we receive and which pages are read the most, it would work without cookies and we would only see aggregate statistics. The legal basis would also be our legitimate interest in improving the website.
The website does not use first-party analytics or advertising cookies. We explain what is stored in your browser in the cookie policy.
Minors
The website and our services are only for people aged 18 or older, and we do not knowingly process data of minors. If we find out that a request or a message comes from a minor, we delete their data and do not take it any further.
If you are a parent or legal guardian and believe that a minor in your care has sent us their data, write to us and we will delete it.
Who we share your data with
We do not sell your data or give it to other companies for them to use for their own purposes. We would only disclose it to authorities, courts or public administrations if a law required us to do so.
For the website and the forms to work, we use providers that process data on our behalf (processors). They may only use it to provide their service to us, following our instructions and with the safeguards required by Article 28 of the GDPR:
| Provider | What we use it for |
|---|---|
| Cloudflare, Inc. | Hosts the website, protects the forms against spam (Cloudflare Turnstile) and, if we enable it, measures visits without cookies (Cloudflare Web Analytics) |
| Contabo GmbH (Germany) | Hosts the server for our email, where the website forms reach us by email |
If we talk on WhatsApp (because you write to us or because we contact you there after your request), the conversation goes through WhatsApp, a Meta service. Meta also processes some data in accordance with its own privacy policy.
Data outside the European Economic Area
Cloudflare may process data outside the European Economic Area (EEA). In those cases, the transfer relies on the safeguards provided for in the GDPR, such as the EU-U.S. Data Privacy Framework or the standard contractual clauses approved by the European Commission.
If you would like to know which safeguard applies in each case or to ask us for a copy, write to us at contacto@ofagencia.com.
How long we keep your data
We keep your data only for as long as necessary to handle your request, your job application or your message. After that, we keep it blocked, that is, set aside and not used, for the duration of the legal periods during which liability claims could be brought against us. Once that time has passed, we delete it.
If you withdraw your consent or object to the processing, we stop using your data for that purpose, unless we have to keep it blocked because of a legal obligation.
Your rights
You can exercise the following rights over your data at any time:
- Access: find out whether we process your data and obtain a copy.
- Rectification: correct inaccurate or incomplete data.
- Erasure: ask us to delete it.
- Objection: ask us to stop processing it on grounds relating to your particular situation, when we rely on our legitimate interest.
- Restriction: ask us to keep it without using it, for example while we check whether it is accurate.
- Portability: receive the data you gave us in a commonly used digital format, or ask us to send it to another company, when we process it on the basis of your consent or for a contract or the steps prior to entering into one.
- Withdraw your consent: whenever you want, without affecting anything we did on the basis of it before.
How to exercise them. Write to us at contacto@ofagencia.com and tell us which right you want to exercise. It is free of charge. If we have reasonable doubts about your identity, we may ask you for additional information to confirm it. We will reply within one month at most, a period that may be extended by two further months if the request is complex or we receive a large number of requests; if that happens, we will let you know within the first month.
If you believe we have not handled your data properly, you can lodge a complaint with the Spanish Data Protection Agency (AEPD, www.aepd.es) or with the data protection authority of the European Economic Area country where you live or work. If you wish, you can write to us first and we will try to resolve it.
Automated decision-making
We do not make decisions about you based solely on automated processing, including profiling. Requests and job applications are assessed by people on our team.
How we protect your data
We apply appropriate technical and organizational measures to protect your data against loss, unauthorized access or misuse. For example, the website runs over an encrypted connection (HTTPS) and the forms are protected against spam. If we ever suffered a security breach that posed a high risk to you, we would let you know.
Changes to this policy
We may update this policy if the law or the way we process data changes. You will always see the date of the last update at the top. If we make a significant change that affects data you have already given us, we will let you know.
