These terms set out the conditions for using ofagencia.com, the website of OF Agencia, a trade name of WEBYSAM S.L. You can find all of the company’s details in the legal notice.

This is an English translation provided for convenience. In case of any discrepancy, the Spanish version prevails.

By browsing the website, you accept these terms. If you do not agree with them, we ask you not to use it.

What these terms cover

These terms govern the use of the website: browsing it, reading the blog, submitting forms and contacting us.

They are not the agency’s services contract. If you decide to work with OF Agencia, the services, the financial terms, the duration and all other conditions are agreed in a separate contract that we sign with you. Sending a request does not create any commitment: you do not have to hire anything and we are not obliged to accept it.

What we tell you on the website about how we work (for example, that there is no upfront fee and no lock-in contract) is general information. The specific conditions of each collaboration are those set out in the contract.

Only for people aged 18 or older

The website and the agency’s services are only for people aged 18 or older. By using the website, you confirm that you are an adult, and to send a request you must confirm this expressly.

If we find out that a minor has sent us their data, we delete it and do not take things any further.

If you visit us from outside Spain

The website is run from Spain, but we work with creators wherever they are. If you visit it from another country, check that using it, and working as a content creator, is allowed where you live: each person is responsible for complying with the laws of their own country.

Proper use of the website

You may use the website to get information and to contact us. In return, we ask you to use it lawfully, in good faith and respectfully. In particular, you may not:

  • Submit false information, or someone else’s information, in the forms.
  • Impersonate another person or a company.
  • Send us, through the website, on WhatsApp or by email, content that is illegal, offensive or that infringes other people’s rights, such as photos of someone without their permission.
  • Submit forms automatically or in bulk, or use them to send advertising or spam.
  • Introduce viruses or malicious code, try to access parts of the website that are not public, or do anything that could damage it, overload it or prevent it from working normally.

We do not need passwords or explicit photos to assess your profile: do not send them to us.

If anyone breaks these rules, we may discard their requests or messages, block their access to the website and, if necessary, take the appropriate legal action.

Intellectual and industrial property

The texts, the design, the OF Agencia trademark and logo, the images, the videos, the code and all other content on the website belong to WEBYSAM S.L. or to third parties who allow us to use them, and they are protected by intellectual and industrial property laws.

You may view the website, save or print pages for your personal use and share links to them. What you may not do without our written permission is reproduce, distribute, communicate to the public or transform its content, in whole or in part, or remove authorship notices, except in the cases permitted by law, such as the right of quotation. Crawling of the website by search engines and other automated systems is governed by what our robots.txt file specifies.

The third-party trademarks that appear on the website, such as OnlyFans, TikTok, Instagram, YouTube, X or Telegram, belong to their owners. The notice that we are not affiliated with OnlyFans and the credits for the elements we use under open licenses are in the legal notice.

Blog content: information, not advice

The blog articles and the guides on the website are general, informative content. They are not tax, legal or financial advice, and they do not replace the opinion of a professional who knows your case.

Laws, taxes and the rules of OnlyFans and social networks change and vary from country to country. We try to make sure that what we publish is accurate and up to date, but it may become outdated or contain errors. Before making an important decision, especially about taxes or contracts, check the official sources or consult a professional advisor.

Earnings results vary

What you can earn as a creator depends on many factors: your content, your consistency, your niche, your audience, the rules of each platform and the state of the market at the time. Therefore:

  • We do not guarantee any level of earnings, subscribers or followers.
  • The figures, cases and testimonials we show are specific, illustrative situations: other people’s results do not guarantee yours.

The website contains links to other websites, such as social networks. We do not control them, so we are not responsible for their content, how they work or their privacy policies: we recommend that you read their terms. If we learn that a linked website contains unlawful content, we will remove the link as soon as possible.

You may link to any page on ofagencia.com as long as the link leads to the original website (without framing it or copying its content), does not imply a relationship with us that does not exist and is not placed on websites with illegal content.

Liability

We work to make sure the website runs well and is secure, but we cannot guarantee that it will always be available or free of errors. Sometimes we will have to interrupt it, for example to carry out maintenance or improvements.

To the extent permitted by law, we are not liable for any damage that may arise from:

  • Interruptions, technical failures or connection problems that are beyond our control.
  • Viruses or attacks by third parties, despite the security measures we apply.
  • Use of the website contrary to these terms or the law.
  • Decisions you make based solely on the informative content of the website.
  • The content of third-party websites we link to.

None of this limits our liability in cases where the law does not allow it to be excluded, nor the rights granted to you by consumer protection legislation.

Forms and personal data

When you send us a form, you undertake that the information is true and your own. We explain how we process it in the privacy policy, and what is stored in your browser in the cookie policy.

Changes to the website and to these terms

We may change, expand or remove content on the website whenever we need to. We may also update these terms, for example if the law or the website itself changes. The version in force is always the one published on this page, with its update date at the top, and it applies from the moment we publish it.

Governing law and jurisdiction

These terms are governed by Spanish law.

If you have any problem with the website, write to us at contacto@ofagencia.com and we will try to resolve it amicably. If we do not reach an agreement, the courts and tribunals of Málaga (Spain) will have jurisdiction, unless the law provides otherwise.

If you are acting as a consumer, you may go to the courts of your place of domicile, and the choice of Spanish law does not deprive you of the protection afforded to you by the rules of your country of residence that cannot be excluded by contract.
